Ordinance – Page 1 <br />ORDINANCE NO. ________ <br />AN ORDINANCE CONCERNING PROTECTIONS FOR INDIVIDUALS AND <br />AMENDING SECTION 2.497 OF THE EUGENE CODE, 1971. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Section 2.497 of the Eugene Code, 1971, is amended to provide as follows: <br />2.497 Information Not to Be Collected or Maintained. <br />(1)No city law enforcement personnel may collect or maintain information about <br />the political, religious or social views, associations or activities of any <br />individual, group, association, organization, corporation, business or <br />partnership unless such information directly relates to an investigation of <br />criminal activities, and there are reasonable grounds to suspect the subject of <br />the information is or may be involved in criminal conduct. <br />(2)No non-law enforcement personnel working for the city may collect or maintain <br />information about the political, religious or social views of any individual. <br />(3)No city employee may collect or maintain individually identifiable <br />immigration status information unless (a) such collection and <br />maintenance is required to comply with state or federal law; (b) the <br />individually identifiable immigration status information is voluntarily <br />provided to the city by the individual; or (c) the information is provided <br />to the city as part of a city application process for employment or a <br />contract with the city, or a business permit or license from the city. <br />Section 2. The City Recorder, at the request of, or with the consent of the City Attorney, <br />is authorized to administratively correct any reference errors contained herein, or in other <br />provisions of the Eugene Code, 1971, to the provisions added, amended or repealed herein. <br />Passed by the City Council this Approved by the Mayor this <br />______day of _______________, 2019 ____ day of ________________, 2019 <br />____________________________ _____________________________ <br />City Recorder Mayor <br />ATTACHMENT B <br />September 16, 2019, Public Hearing – Item 1
