<br />Section 8. <br /> If any section, subsection, sentence, clause, phrase or portion of this <br />Ordinance is for any reason held invalid or unconstitutional by a court of competent <br />jurisdiction, such portion shall be deemed a separate, distinct and independent <br />provision and such holding shall not affect the validity of the remaining portions hereof. <br /> <br /> Section 9. <br /> Notwithstanding the effective date of ordinances as provided in the <br />Eugene Charter of 2002, in order to prohibit any inappropriate infill development that <br />could occur as the result of the period between passage of this Ordinance and the 30 <br />day effective date provided in the Eugene Charter of 2002, this Ordinance shall become <br />effective immediately upon its passage by the City Council and approval by the Mayor <br />or passage over the Mayor’s veto. <br /> <br />Section 10 <br />. This Ordinance will be automatically repealed effective midnight on <br />January 1, 2009, unless prior to that date the City Council has either amended this <br />Ordinance to extend its effective date or repealed this Ordinance. Upon repeal of this <br />Ordinance, the area depicted on Exhibits A and B shall return to the Medium Density <br />Residential Metro Plan designation and to the Low-Medium Density Residential <br />designation on the Jefferson/Far West Refinement Plan land use diagram, and the <br />language deleted by this Ordinance from the Jefferson/Far West Refinement Plan <br />Residential Area Policy 15 shall be restored in both the Jefferson/Far West Refinement <br />Plan and in Section 9.9580(17) of the Eugene Code, 1971. <br /> <br /> <br />Passed by the City Council this Approved by the Mayor this <br /> <br />____ day of ______________, 2007. ____ day of _____________, 2007. <br /> <br /> <br />_______________________________ _______________________________ <br /> City Recorder Mayor <br /> <br /> <br />
