In response to the public notice, staff received one piece of testimony—a letter from Louis Bauer (provided as Attachment C). To summarize, Bauer opposes annexation of the entire property, and proposes that only approximately one-half of the site be annexed and that adjacent property owners be provided an opportunity to purchase parts of the subject property remaining unannexed under Bauer’s plan. As City Council is aware, annexation is often the first step on the part of a property owner in preparing property for development within the City of Eugene. The only question before council with this annexation request is whether the subject property can be included in the city limits, consistent with applicable Eugene Code requirements. Any applicable, subsequent development will require the appropriate land use application, such as a subdividing the property, which will entail a separate public process. Based on this information, staff does not believe a public hearing is warranted. Referral comments were provided by affected agencies including City of Eugene Public Works, Eugene Water & Electric Board, and Lane County Public Works. These referral comments confirm that the property can be provided with the minimum level of key urban services consistent with the approval criteria. Given the findings of compliance, ability for the provision of key urban services, and lack of testimony received pertaining to the substance of the application, a public hearing is not recommended in this instance. Defer action until after the council holds a public hearing on the proposed annexation <br />CITY MANAGER’S RECOMMENDATION The City Manager recommends City Council adopt the resolution by finding that the request complies with all applicable approval criteria, and that the annexation be approved. <br />
