(c) "Within 1,000 Feet" means a straight line measurement in a radius <br />extending for 1,000 feet or less in every direction from the closest point <br />anywhere on the premises of a retail marijuana use to the closest point <br />anywhere on the premises of another retail marijuana use. <br />Section 3. The "Specialty Store" entry under the "Trade (Retail and Wholesale")" section <br />in Table 9.2450 of Section 9.2450 of the Eugene Code, 1971, is amended to provide as follows: <br />9.2450 Emplovment and Industrial Zone Land Use and Permit Reauirements. The <br />following Table 9.2450 Employment and Industrial Zone Land Use and Permit <br />Requirements identifies those uses in the Employment and Industrial Zones that <br />are: <br />(P) Permitted. <br />(SR) Permitted, subject to an approved site review plan or an approved final <br />planned unit development. <br />(C) Subject to a conditional use permit or an approved final planned unit <br />development. <br />(S) Permitted, subject to the Special Development Standards for Certain Uses <br />beginning at EC 9.5000. <br />(#) The numbers in ( ) in the table are uses that have special use limitations that <br />are described in EC 9.2451. <br />The examples listed in Table 9.2450 are for informational purposes and are not exclusive. Table <br />9.2450 does not indicate uses subject to Standards Review. A new subsection (7) is added to Section 9.2451 of the Eugene Code, 1971, to <br />provide as follows: <br />9.2451 Special Use Limitations for Table 9.2450. <br />(7) Separation between Retail Marijuana Uses. No portion of the premises of a <br />retail marijuana use may be located within 1,000 feet from the premises of <br />another retail marijuana use. <br />(a) "Premises" means the location of a retail marijuana use described in a <br />license issued by the Oregon Liquor Control Commission pursuant to <br />ORS 4786.105. <br />(b) "Retail Marijuana Use" means a recreational marijuana retail facility <br />licensed by the Oregon Liquor Control Commission pursuant to ORS <br />4786.105. <br />(c) "Within 1,000 Feet" means a straight line measurement in a radius <br />extending for 1,000 feet or less in every direction from the closest point <br />anywhere on the premises of a retail marijuana use to the closest point <br />anywhere on the premises of another retail marijuana use. <br />Ordinance - Page 2 of 8 <br />
