ATTACHMENT A <br /> <br />Summary of Proposed Amendments <br />Accessory Dwellings <br /> <br />The proposed ordinance includes the following amendments: <br />• Replaces all references of “secondary dwelling” with “accessory dwelling” <br />• Clarifies that accessory dwellings are not accessory buildings <br />• Aligns the definition of accessory dwelling with that provided in ORS 197.312(5). <br />• Adds accessory dwellings as an explicitly permitted uses in the following zones: <br />o AG Agricultural <br />o R-2 Medium Density Residential <br />o R-3 Limited High-Density Residential <br />o R-4 High Density Residential <br />o S-E Elmira Road Special Area Zone <br />o S-HB Blair Boulevard Historic Commercial Special Area Zone <br />• Clarifies that uses allowed in the S-JW Jefferson Westside Special Area Zone and S-C <br />Chambers Special Area zone include what the State defines as an “accessory dwelling unit,” <br />but the two zones refer to the use as an additional “one-family dwelling” <br />• Applies the R-1 Low Density Residential zone standards for accessory dwellings to <br />accessory dwellings in the following zones: <br />o AG Agricultural <br />o R-2 Medium Density Residential <br />o R-3 Limited High-Density Residential <br />o R-4 High Density Residential <br />o S-E Elmira Road Special Area Zone <br />• Based on ORS 197.312(5), which requires the city to have “reasonable local regulations <br />relating to siting and design” for accessory dwellings, removes or changes regulations that: <br />o Prohibit accessory dwellings on new flag lots <br />o Require owner/occupancy of either the accessory or primary dwelling <br />o Limit the maximum number of bedrooms in an accessory dwelling <br />o Limit the maximum number of occupants in an accessory dwelling based on the <br />number of occupants in the primary dwelling for properties within the boundaries of <br />the Amazon, Fairmount and South University neighborhood associations. <br />o Regulate dog keeping <br />o Require off-street parking for accessory dwellings and regulate the development of <br />required parking for accessory dwellings* <br /> <br />• Per Council motion passed on October 23, 2019, remove the barriers to accessory <br />dwellings on sloped lots and above garages* <br /> <br />*These are the only changes from the draft ordinance provided for the May 20, 2019 City Council public hearing. <br />January 21, 2020, Work Session - Item 1
