January 21, 2020, Work Session – Item 1 Revised Ordinance/Findings In response to City Council’s direction, LUBA’s Order and the 2019 law, Planning and legal staff have prepared the below listed documents. They have been revised since the May 20, 2019, public hearing as necessary to eliminate code requirements related to off-street parking and related standards that regulate how the required off-street parking is to be developed and to incorporate the changes to building height/setbacks as directed by council at the October 23, 2019, work session. As previously noted, a few non-substantive changes have also been made to correct reference errors. A Summary of Amendments is provided in Attachment A. A Draft Ordinance is provided in Attachment B. Draft Findings to justify the retention of the standards City Council found to be “reasonable regulations relating to siting and design” are provided in Attachment C. Draft Findings addressing Eugene Code criteria/policies and statewide planning goals are provided in Attachment D. Alternative Draft Findings that could be used if council decides to retain certain accessory dwelling standards that were initially identified for removal (provided per council’s request) or are proposed for removal are provided in Attachment E. These were revised to address the previously described actions by removing the findings pertaining to owner/occupancy and including two standards related to parking requirements. Record of Materials for the City Council’s Consideration Because the City’s consideration of the draft ordinance is a continuation of the process started in 2018, all the materials that were compiled for the 2018 process continue to be a part of the record for the council’s consideration. A link to all written testimony received as part of the remand process, through January 6, 2020, is provided as Attachment F. A complete set of record materials are available for review in a binder located at the City Council Office as well as at the Planning and Development Department, located at 99 W. 10th Avenue. (Motion Passed) April 16, 2018 Public Hearing May 23, 2018 Work Session June 11, 2018 Work Session Move to substitute Attachment B to the AIS, which is labeled “Ordinance 1 / Substitute Ordinance,” in place of the Ordinance #1 now on the table. Move to adopt Ordinance #2, Attachment C to the AIS. (Motions Passed) February 20, 2019 Work Session Move to direct the City Manager to prepare a proposed ordinance consistent with council’s direction on accessory dwelling units, and to schedule a public hearing on the proposed ordinance in response to LUBA’s remand.
