Ms. Childs said that there was nothing in the record that would allow staff to give Councilor Farr <br />the answers he wanted. She said that nothing had been received from the Oregon Department of <br />Transportation during the course of the hearing process. She reiterated that there was no <br />information on the record that would allow staff to answer his question. <br /> <br />Mayor Torrey noted that they were discussing Councilor Nathanson's ward and that she would <br />wish to be present if any changes were made to the ordinance being voted on. He suggested <br />holding Councilor Kelly's motion until the work session on August 2. <br /> <br />City Manager Johnson suggested preparing the ordinance as Councilor Kelly suggested and <br />presenting it with the current item as two options for that meeting. <br /> <br />Councilor Rayor said that he would vote against the amendment. He expressed a hope to take the <br />item back to the table and get more staff input on options. <br /> <br />Councilor Pap8 stated for the record that he had a discussion with Mr. Holtar regarding whether or <br />not a proposal had been submitted by him and answered by staff. <br /> <br />In response to a question from Councilor Pap8 regarding the possibility of taking judicial notice in <br />the matter, City Attorney Klein said that the Council had a limited ability to take judicial notice of <br />certain kinds of things under the Eugene Code. He cited, ordinances, official records, and <br />resolutions as examples. He said that judicial notice could be taken of the Oregon Department of <br />Transportation's records in the current issue. <br /> <br />Councilor Kelly expressed his discomfort with the discussion. He noted that the record had been <br />closed. He also noted that the intent of the West Eugene Wetlands Plan was not to examine <br />specific development proposals, and opined that the council was doing just that. <br /> <br /> Roll call vote; the motion resulted in a tie. Mayor Torrey voted in <br /> opposition. The motion failed, 4:3, with councilors PapS, Meisner, <br /> and Kelly voting in favor. <br /> <br />The meeting adjourned at 10:40 p.m.. <br /> <br />Respectfully submitted, <br /> <br />James R.
