ADMINISTRATIVE ORDER NO. 53-20-03 <br />of the <br />City Manager Pro Tern <br />AMENDING THE TERMS OF USE FOR THE DUSK TO DAWN SITE AT <br />605 AND 717 HIGHWAY 99 AND REPEALING ADMINISTRATIVE ORDER <br />NO. 53-18-19. <br />The City Manager Pro Tern of the City of Eugene finds that: <br />A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the <br />City Manager is designated as the administrative head of the City and is authorized to enforce all <br />ordinances of the City. <br />B. On November 23, 2015, Ordinance No. 20559 was adopted approving the Dusk to <br />Dawn overnight sleeping pilot program. That Ordinance provided that sleeping overnight at <br />designated sites would be permitted upon Council's approval of a site and the City Manager's <br />adoption of an administrative rule governing use of the site. Ordinance No. 20559 was amended <br />on March 14 , 2016, by Ordinance No. 20563 to allow the City Manager to consider the seasonal <br />sunset in determining the hours of permitted overnight sleeping at designated sites. <br />C. On March 1, 2017 , Ordinance No. 20576 was adopted removing the sunset date <br />from the Dusk to Dawn Program. On March 29 , 2017 , the City Manager issued Administrative <br />Order No. 53-17-03-F, adopting permanent rules and regulations for the Dusk to Dawn Overnight <br />Sleeping Program. <br />D. On October 23, 2017, the City Council approved a Dusk to Dawn site at 605 and <br />717 Highway 99 to replace a former site at the Eugene Service Station and allow for expanded <br />capacity. On October 31, 2017, the City Manager issued Administrative Order No. 53-17-06 <br />authorizing up to 80 persons to sleep overnight at that site. Since that time , the City Manager has <br />authorized increases in the number of persons permitted to use the site. Currently, pursuant to <br />Administrative Order No. 53-18-19, up to 220 persons are authorized to sleep overnight at the site. <br />E. It is necessary to amend the terms of the use for the Highway 99 site to allow more <br />people to use the site. <br />NOW THEREFORE, based on the above findings, I order that: <br />1. The terms of use for the 605 and 717 Highway 99 Dusk to Dawn overnight sleeping <br />site are amended to provide as follows: <br />Up to 256 persons may sleep overnight at 605 and 717 Highway 99 pursuant to the Dusk <br />to Dawn overnight sleeping program (a) adopted by Ordinance No. 20559, and amended <br />Administrative Order -Page 1 of 2
