RESOLUTION NO. 5291 <br />A RESOLUTION REPEALING RESOLUTION NO. 3993 REGARDING <br />THE ABATEMENT OF DUTCH ELM DISEASE. <br />The City Council of the City of Eugene finds that: <br />A. On July 28, 1986, the City Council adopted Resolution No. 3993 declaring Dutch <br />Elm disease to be a public nuisance, requesting the City Manager to abate from private property <br />all trees diseased with Dutch Elm disease, and (in order to limit the spread of the disease) <br />prohibiting anyone other than authorized City personnel from cutting or removing any elm tree, <br />or wood, limbs, branches and other debris from an elm tree. <br />B. Despite the City's abatement efforts, a significant number of elm trees have been <br />lost and the City's remaining population of elms does not justify the administration of a public <br />abatement program or the prohibition on private parties' cutting or removal of the trees. <br />NOW, THEREFORE, <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br />Municipal Corporation of the State of Oregon, as follows: <br />Section 1. Resolution No. 3993 declaring Dutch Elm disease to be a public nuisance and <br />authorizing the abatement is repealed. <br />Section 2.
