April 13, 2020, Meeting – Item 4 <br />Public Hearing Notice & Procedures The notice of the Planning Commission public hearing went beyond the minimum requirements for this Type IV land use application, including mailed notice to property owners and occupants of property within 300 feet of the site, Eugene neighborhood organizations, the Oregon Department of Land Conservation and Development, Oregon Department of Transportation, Lane County, City of Springfield and other community groups and individuals who have requested notice or who were identified as interested parties in the 2019 process. Signs announcing the Planning Commission hearing were posted on and around the property in six locations. Notice of the City Council’s hearing was published in the Register-Guard and mailed in accordance with EC 9.7440. Nonetheless, no testimony, written or otherwise, has been received to date. Any written comments received after the preparation of this agenda item summary will be provided to the City Council prior to the public hearing, for inclusion into the public record. Assuming there are no issues of concern raised at the public hearing, the ordinance presented for council action on April 27, 2020, will include an immediate effective date. Construction of the Downtown Riverfront Park is scheduled to begin in early May 2020. An immediate effective date will enable City staff to include the pavilion-related construction work in the construction contract so that the construction for the art pavilion will take place as an integrated part of construction of the 5th Avenue overlook. As relevant, EC 9.8065 states: “[i]f the City Council elects to act, it may, by ordinance, adopt an amendment to this land use code that: (1) Is consistent with applicable statewide planning goals as adopted by the Land Conservation and Development Commission; and (2) Is consistent with applicable provisions of the comprehensive plan and applicable adopted refinement plans.” The proposed ordinance does not make a substantive change; it clarifies the previously-approved development. The findings adopted by the City Council for Ordinance No. 20619 are included in the record for this action to demonstrate consistency with these criteria. <br />PREVIOUS COUNCIL DIRECTION On July 22, 2019, the Eugene City Council approved Ordinance No. 20619. Section 3 of that Ordinance approved amendments to EC 9.3155(15), which regulates development within view corridor areas of the Downtown Riverfront Special Area Zone. Section 8 of that Ordinance approved /WR Water Resources Overlay Zone Standards Review application No. SDR 19-2, including the art pavilion at a location within the view corridor area extending from 5th Street. <br />COUNCIL OPTIONS No action is required at this time; however, options will be provided at the time of City Council action scheduled for April 27, 2020. <br />CITY MANAGER’S RECOMMENDATION This item is scheduled for a public hearing only. Following the public hearing and City’s receipt of any testimony, the City Manager will make a recommendation for action on April 27, 2020. <br />CC Agenda - Page 44
