<br /> <br />The specific level of development allowable on these properties is in dispute and the value of these <br />properties is dependent on what level of development is ultimately decided allowable. Appraisals have <br />not yet been performed. Consequently, it is not possible to identify the cost to the City in acquiring <br />these parcels. <br /> <br />Several documents were provided to the council in the packet for the May 21, 2007, Public Hearing <br />which are not included here again. If councilors wish to review these documents, they include: <br /> <br />A memo dated May 9, 2007, from the City Attorney titled “An Overview of Condemnation <br />? <br /> <br />Procedures and Statutory Authorization to Acquire Property for City Parks” <br />A memo dated May 3, 2007, from Planning and Development Department regarding the zoning, <br />? <br /> <br />history of land use applications, and conditions of the Green and Beverly properties <br />A memo dated May 4, 2007, from the Parks and Open Space Division providing information <br />? <br /> <br />regarding the “park values” represented by these properties <br /> <br /> <br />RELATED CITY POLICIES <br />The PROS Comprehensive Plan was adopted by the council on February 13, 2006. <br />? <br /> <br />The PROS Project and Priority Plan was adopted by the council on May 22, 2006. <br />? <br /> <br />A Parks and Open Space Bond Measure passed by Eugene voters on November 7, 2006. <br />? <br /> <br /> <br /> <br />COUNCIL OPTIONS <br /> <br />A.Adopt the ordinance. <br /> <br />B.Direct the City Manager to continue acquisition negotiations on both the Beverly and Green <br /> properties and, if those continue to fail, bring the issue back to the council for reconsideration if <br /> additional development approval is granted for either property; <br /> <br />C.Direct the City Manager to retain an appraiser and other necessary experts in order to obtain <br /> appraisals for the two properties, and then bring that information back to the council in a future <br /> executive session; <br /> <br />D.Take other action, as directed by the council. <br /> <br /> <br />CITY MANAGER’S RECOMMENDATION <br /> <br />The City Manager recommends Option B:Direct the City Manager to continue acquisition negotiations <br />on both the Beverly and Green properties and, if those continue to fail, bring the issue back to the <br /> <br />council for reconsideration if additional development approval is granted for either property; <br /> <br /> <br />SUGGESTED MOTION <br /> <br />Move to direct the City Manager to continue acquisition negotiations on both the Beverly and Green <br />properties and, if those continue to fail, bring the issue back to the council for reconsideration if <br />additional development approval is granted for either property. <br /> <br /> <br /> <br />L:\CMO\2007 Council Agendas\M070625\S0706255.DOC <br />
