<br />together constitute the Eugene Fire Code (EFC). This rule is in addition to, and is not exclusive <br />of, Administrative Rule R-8.005. References in this rule to "this code" are references to the OFC <br />adopted herein. <br /> <br />R-8.010FC-B <br /> <br />AMENDMENTS. <br /> <br />1. Section 101.2.1 of the OFC is amended to provide: <br /> <br />101.2.1 Appendices specifically adopted. Provisions in the appendices shall not apply <br />unless specifically adopted. The provisions of the following appendices are adopted as part of <br />this code: B, C, D, EI02 (Hazard Categories), H, I and L. <br /> <br />2. The text of Section 105.6.20, which precedes Table No. 105.6.20, of the OFC is <br />amended to provide: <br /> <br />105.6.20 <br /> <br />Hazardous materials. A permit shall be obtained from the Hazardous Materials <br />Regulation Section to store, transport on site, dispense, use, or handle hazardous <br />materials in excess of the amounts listed in Table No. 105.6.20 or to install, <br />repair, abandon, remove, place temporarily out of service, close, or substantially <br />modify a storage facility or other area regulated by Chapters 27 through 44 of this <br />code when the hazardous materials in use or storage exceed the amounts listed in <br />Table No. 105.6.20. <br />a. Hazardous Materials-Permit Required. <br />A. No person shall store, use, handle manufacture, process, dispense, <br />and/or dispose of any regulated hazardous materials, as defined in <br />Section 2702.1, without a valid permit. <br />B. A permit shall specify the facility where the hazardous materials <br />may be present. <br />C. No hazardous materials other than those identified in a permit may <br />be located at a facility. <br />D. An applicant shall be issued a permit where: <br />(i) The applicant has submitted a completed application for a <br />permit, in a form provided by the chief, and has paid all <br />required fees; <br />(ii) The applicant states in the application that he or she has <br />personal knowledge of the information provided in the <br />application; <br />(iii) The applicant executes and delivers to the fire department <br />an agreement provided by the chief which states that the <br />applicant shall hold harmless the city, its officers, agents <br />and employees, for any claims that may arise as a result of <br />any activity carried on by the applicant at the facility or <br />related to hazardous materials identified in the permit; and <br /> <br />Administrative Order - 2 of 12 <br />C:\Documents and Settings\cefddwp\Local Settings\Temporary Internet Files\OLK2A\_07 fire code - 2 ao (00174830).doc <br />
