<br />ADMINISTRATIVE ORDER NO. 52-07-04-F <br />of the <br />City Manager of the City of Eugene <br /> <br />AMENDMENT OF EUGENE FIRE AND EMS DEPARTMENT SERVICES <br />FEE SCHEDULE AND REPEAL OF ADMINISTRATIVE ORDER NO. 52- <br />05-02- F. <br /> <br />The City Manager of the City of Eugene finds as follows: <br /> <br />A. Section 2.020 of the Eugene, Code, 1971 authorizes the City Manager to <br />determine and set fees and charges to be imposed by the City for services, goods, use of <br />municipal property, and licenses and permits. <br /> <br />B. In accordance with those procedures, on May 15, 2007, I issued Administrative <br />Order No. 52-07-04 proposing to amend the Fire and EMS Department Services Fee Schedule <br />that had been established by Administrative Order No. 52-05-02-F on September 28, 2005. A <br />Notice of Intended Amendment of Fees was attached to Administrative Order No. 52-07-04 as <br />Exhibit A, and included the current and proposed fees. <br /> <br />C. Copies of the Notice were sent to the Mayor and City Councilors. Copies of the <br />Notice were also posted at two locations at City Hall on May 29, 2007, and made available for <br />inspection by interested persons at the office of the City's Fire Marshal, Fire and Emergency <br />Medical Services Department, 1320 Willamette Street, Eugene, Oregon, 97401, during normal <br />business hours (8:00 a.m. to 5:00 p.m., Monday through Friday, exclusive of holidays). The <br />Notice provided that written comments would be received for a period of 15 days from the date <br />of posting. No written comments were received within the time or in the manner provided in the <br />Notice. <br /> <br />D. Based upon the above findings and the findings in Administrative Order No. 52- <br />07-04, I find that the Fire and EMS Department Services Fee Schedule should be amended as <br />proposed. Amendment of the fee schedule is necessary to more accurately reflect cost recovery <br />related to the services provided, and are based on the City's increased salary, benefit and support <br />costs for the employees performing the services. In determining the fees, I have considered the <br />applicable policies, enactments and directives of the City. Council, the amount charged for these <br />services by the City in the past, the full costs of providing these services supported by the fees, <br />the amounts charged by other comparable providers, and the revenue needs of the City as <br />determined by the adopted City budget. <br /> <br />On the basis of these findings, I order that: <br /> <br />1. The fees set forth in the attached Exhibit A are the fees to be charged for the <br />described services as of the effective date of this Order. <br /> <br />2. The unamended fees established by Administrative Order No. 52-05-02-F remain <br />in full force and effect and are incorporated into the new fee schedule attached as Exhibit A. <br /> <br />3. <br />Order. <br /> <br />Administrative Order No. 52-05-02-F is repealed as of the effective date of this <br /> <br />Administrative Order -- Page 1 of 2 <br />C:\Documents and Settings\cefddwp\Local Settings\Temporary Internet Files\OLK2A'-07 fire-ems fees - 2 ao (00174838).doc <br />
