of/he Eugene Code, 1971 and the requirements of applicable state and local law as described in the <br />findings adopted in support of this Ordinance. <br /> <br />NOW, THEREFORE, <br /> <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br /> <br /> Section 1. The Metro Plan Diagram is amended to redesignate property identified as <br />A <br /> ssessor s map 17-04-30, tax lots 200 and 300, from "Agriculture/Urban Reserve" to '~Rural <br />Residential/Urban Reserve" as depicted in Exhibit A attached hereto and incorporated herein. <br /> <br /> Section 2. Findings of fact made pursuant to LCDC Statewide Planning Goal 2 exception <br />criteria for taking an Exception to Goal 3, Agricultural Lands, for the property described in section <br />1 of the Ordinance, taken in accordance with Oregon Administrative Rule requirements for statewide <br />planning goal Exceptions, as set forth in pages 7 through 17 of Exhibit B attached to this Ordinance, <br />are adopted as part of the Metro Plan. <br /> <br /> Section 3. Although not part of this Ordinance, the findings in attached Exhibit B are <br />adopted in support of this Ordinance. <br /> <br /> Section 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance <br />is fc, r any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion <br />shall be deemed a separate, distinct and independent provision, and such holding shall not affbct the <br />validity of the remaining portions hereof. <br /> <br /> Section 5. Notwithstanding the provisions of the Eugene Charter of 1976, this Ordinance <br />shall not become effective until identical provisions are adopted by the Lane County Board of <br />Commissioners and Springfield City Council. <br /> <br />Passed by the City Council this <br />5th day of March, 2001 <br /> <br /> City Recorder <br /> <br />Approved by the Mayor this <br />5tt' day of March, 2001 <br /> <br />Ordinance - 2 <br /> <br /> <br />
