(c) Access Pole. The minimum width for the pole portion of 1 flag lot is 15 <br /> feet. If 2 or more flag lots will use the same access driveway, the <br /> minimum combined width of the pole portions shall be 25 fbet. A street <br /> may be require& The maximum number of flag lots taking access off the <br /> same access driveway is 4. <br />(d) Ownershil2. The access pole must be part of the flag lot and must be 'under <br /> the same ownership as the flag portion. <br />(e) Land DNision Review. All applicable regulations for the type of land <br /> division process being used must be met except where the residential flag <br /> lot standards create different requirements. <br /> <br />Section 14~ Subsection (3)(c)4. of Section 9.2795 of the Eugene Code; 1971, is amended to <br /> <br />provide: <br /> <br />9.2795 Solar Setback Standards. <br /> <br />(3) Exem ptions to Solar Setback Requirements. A building is exempt from the <br /> solar sefback standards when any of the following conditions exist: <br /> <br />(c) Insignificant BenefiL The building 'will shade one or more of the <br /> following: <br /> <br />No more than 20% of a south wall of an ex/sting habitable dwelling. <br />See Figures 9.2795(2), 9.2795(2)(a) and 9.2795(2)(b). <br /> <br />Section 15~ Section 9.4260 of the Eugene Code, 1971, is amended to provide: <br /> <br />%426~) <br /> <br /> r Apply~ngthe/ND Nodal Development Overla35 Zone~ <br />Notwithstanding EC 9.8855, rezoning to apply the/ND overlay zone shall be <br />processed as a Type V application as provided in EC 9.7500 through EC 9.7560 Type <br />V Application Procedures. In addition to the requirements of the base <br />zone, the following standards shall apply: <br /> <br />(4) <br /> <br />A4iustments.
