ADMINISTRATIVE ORDER NO. 21-04-04 <br /> of the <br /> City Manager <br /> City of Eugene, Oregon <br /> <br /> CONFIRMING WORKERS' COMPENSATION COVERAGE <br /> FOR CITY VOLUNTEER POLICE OFFICERS (POLICE <br /> RESERVES). <br /> <br /> The City Manager of the City of Eugene f'mds that: <br /> <br /> A. ORS 656.031 (2) provides that a City may provide Workers' Compensation coverage <br />for volunteer personnel by declaring its intent through adoption of a resolution of its governing body. <br /> <br /> B. Under the provisions of Chapter IV, Section 16 of the ]Eugene Charter of 2002, the <br />City Manager is designated as the administrative head of the City, specifically authorized to appoint, <br />remove, and &rect all employees (except as otherwise provided in the Charter), and to enforce all <br />ordinances of the City. The powers granted therein to the C~ty Manager are exclusive, and there~br~ <br />the City Manager is reqmred to make the determination under ORS 656.031 (2). <br /> <br /> C. Section 7-210 of the City's Administrative Pohcies and Procedures Manual, which <br />has been approved by the City Manager, provides that the City provides workers' compensation <br />benefits for all regular, limited duration and temporary employees and reserve police officers through <br />a selMnsured, self-administered program. No volunteers except reserve pole, ce officers are covered <br />under the workers' compensation program. <br /> <br /> D, The State of Oregon Workers' Compensation D/vision has requested that the City <br />provide it with appropriate documentation of the City's coverage reflected in F~nding C above. <br /> <br /> Now, therefore, <br /> <br /> The City Manager of the City of Eugene Orders that: <br /> <br /> 1, Based on the above findings~ which are hereby adopte& I hereby reaffirm the intent <br />of the City of Eugene to provide workers' compensation benefits through a self-insured, self- <br />administered program for City of Eugene volunteer police officers (reserve police officers), as set <br />forth in Section 7-210 of the C~ty's Administrative Policies and Procedures Manual ("APPM'*L No <br />volunteers are covered under the workers' compensation program except reserve police officers. <br /> <br />Administrative Order - 1 <br />C 'Documents and Settings ,cepnmld My Documents Workms Comp Admln O~det lot Pohce Volunteer, wpd(03 '22, 04~ <br /> <br /> <br />
