<br /> <br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br />Adoption of Resolution 4948 Annexing Land to the City of Eugene <br />(School District 4-J, A 08-1) <br /> <br /> <br /> <br /> <br /> <br />Meeting Date: October 13, 2008 Agenda Item Number: 2C <br />Department: Planning and Development Staff Contact: Heather O’Donnell <br />www.eugene-or.gov Contact Telephone Number: 541/682-5488 <br /> <br /> <br /> <br /> <br />ISSUE STATEMENT <br /> <br />The City Council will take action on a resolution to annex a parcel of land located on the east side of <br />Coburg Road, north of Kinney Loop, south of Game Farm Road, and owned by Eugene School <br />District 4-J. <br /> <br /> <br />BACKGROUND <br /> <br />On September 15, 2008, the City Council held a public hearing on the annexation of the subject <br />property. At the public hearing, the City Council heard testimony from Jonathan Lauch, representing <br />Eugene School District 4-J. No other testimony, written or otherwise, was received at the hearing. <br />Following the close of the public hearing, the City Council left the record open until 5:00 p.m. on <br />Friday, September 19, 2008, and asked that Mr. Lauch submit his comments in writing. During the open <br />record period, the only written testimony received was submitted by Mr. Lauch. This testimony is <br />provided as Attachment D. <br /> <br />Previously, on July 14, 2008, the City Council voted to defer action on the proposed annexation until <br />after holding a public hearing as allowed under the annexation application procedures of the Eugene <br />Code. Accordingly, the September 15, 2008, public hearing was scheduled and public notice was <br />provided in accordance with Eugene Code requirements. No written testimony was received prior to the <br />public hearing. As addressed in the attached findings, the proposed annexation request complies with <br />the approval criteria from the Eugene Code, as the subject property is located within the urban growth <br />boundary and contiguous to city limits, and given that the minimum level of key urban services can be <br />provided. <br /> <br />Approval of an annexation request requires the City to adopt a resolution. To comply with the Charter <br />requirements for resolutions, a draft resolution approving the requested annexation has been prepared <br />and is attached for reference (Attachment A). The Planning Director’s findings, which provide analysis <br />of the proposal’s compliance with applicable approval criteria, are attached to the draft resolution as <br />Exhibit C. In considering the draft resolution, the City Council will consider the supporting findings and <br />can either accept them as proposed, or amend them as necessary. <br /> <br />Additional background information regarding this request, including relevant application materials, is <br />included for reference as Attachment B.
