topography or likely impact to natural resource areas such <br />as wetlands, ponds, streams, channels, rivers, lakes or <br />upland wildlife habitat area, or a resource on the National <br />Wetland Inventory or under protection by state or federal <br />law. <br />b. Buildings or other existing development on adjacent lands, <br />including previously subdivided but vacant lots or parcels, <br />physically preclude a connection now or in the future, <br />considering the potential for redevelopment. <br />(h) For applications proposing housing to be reviewed with clear and <br />objective approval criteria, exceptions to street connectivity standards <br />may be granted if one of the following conditions exists: <br />1. Existing building(s) on the development site or on land abutting <br />the development site and under separate ownership obstruct the <br />extension of the planned street. For the purposes of this <br />used as a place of occupancy. For the purposes of this <br />detached garage, accessory building, or other structure designed <br />and used solely for storage or shelter; <br />2. Abutting residential land cannot be further divided under current <br />development standards. <br />(i) Street connectivity standards may be adjusted in accordance with EC <br />9.8030(37) for applications proposing housing to be reviewed with clear <br />and objective approval criteria. <br /> <br /> <br /> Section 20. Subsection (5) of Section 9.6820 of the Eugene Code, 1971, is amended <br />and subsection (6) is added, to provide as follows: <br />9.6820 Cul-de-Sacs or Emergency Vehicle Turnarounds. <br />* * * <br />(5) As part of a Type II or Type III process, an exception may be granted to the <br />requirements of (1), (3) and (4) of this section. For applications proposing <br />housing to be reviewed with clear and objective approval criteria, exceptions <br />may only be granted as provided in subparagraph (c). For all other <br />applications, exceptions may be granted because of the existence of one or <br />more of the following conditions: <br />(a) Physical conditions preclude development of the connecting street. <br />Such conditions may include, but are not limited to, topography or likely <br />impact to natural resource areas such as wetlands, ponds, streams, <br />channels, rivers, lakes or upland wildlife habitat areas, or a resource on <br />Ordinance - Page 11 of 34 <br /> <br />
