TheconcurrentamendmenttotheplandesignationontheMetroPlandiagramconstitutesa <br />oramendedcommunityperEC9.8424(2)above.Perthefindingspertainingtothe <br />MetroPlandiagramamendmentatEC9.7735,incorporatedhereinbyreference,the <br />designationchangeisconsistentwithallStatewidePlanningGoalsandtheexistingMetroPlan <br />policies.Therefore,iftherequestedMetroPlanAmendmentisapproved,therefinementplan <br />mustrespondtoremainconsistent.Basedonthesefindings,thiscriterionismet. <br />ZONECHANGEEVALUATION <br />TherequestincludesaconcurrentzonechangerequestfromI2LightMedium <br />IndustrialtoSWSpecialWhiteakerMixedUsewith/SRSiteReviewoverlay,tobringthezoning <br />intoconformancewiththeproposedMixedUseplandesignation.Thefollowingfindings <br />addresstheapplicableapprovalcriteriafortherelatedzonechangerequest: <br />EC9.8865(1):TheproposedchangeisconsistentwithapplicableprovisionsoftheMetro <br />Plan.ThewrittentextoftheMetroPlanshalltakeprecedenceovertheMetroPlandiagram <br />whereapparentconflictsorinconsistenciesexist. <br />AccordingtoEC9.3905,therequestedSWWhiteakerSpecialAreaZoneimplementsthemixed <br />usedesignationoftheWhiteakerPlan.Theanalysisandfindingsundertherefinementplan <br />amendmentcriteria,incorporatedhereinbyreference,providepositivefindingsforconsistency <br />betweentheSW,WhiteakerSpecialAreazoningandthemixedusedesignationoftheMetro <br />Plan.Therefore,asthecurrentMetroPlandesignationisLightMediumindustrial,consistency <br />withthisprovisioniscontingentupontheapprovaloftheMetroPlanAmendmenttoamend <br />landusedesignation.WithrespecttoMetroPlanpolicies,thereappeartobenopoliciesthat <br />wouldserveasmandatoryapprovalcriteriaforthiszonechangeorrequirefurtheranalysis <br />beyondthatprovidedabovefortherequestedplanamendment. <br />Basedonthesefindings,andwithapprovaloftheproposedMetroPlanAmendment,this <br />criterionismet. <br />EC9.8865(2):Theproposedzonechangeisconsistentwithapplicableadoptedrefinement <br />plans.IntheeventofinconsistenciesbetweentheseplansandtheMetroPlan,theMetro <br />Plancontrols. <br />ThesubjectpropertyiswithintheboundariesoftheWhiteakerPlan(WP),whichisthe <br />applicableadoptedrefinementplanfortheareaofthisrequest.TheWPidentifiesthesubject <br />propertyasbeingdesignatedforLightMediumIndustrial.However,accordingtotheMetro <br />PlanAmendmentproceduresatEC9.7730(5)(b),iftherequestedplandiagramamendmentis <br />enactedandnotextintherefinementneedstobeamended,thenthelandusediagramis <br />automaticallyamendedtoremainconsistentwiththeMetroPlan.Therearenotext <br />amendmentsproposedorotherwiserequiredinthisinstance.Therefore,iftheconcurrent <br />MetroPlanAmendmentisapproved,thelandusediagramwillautomaticallybeamended <br />andbeconsistentwiththeproposedzoning.OtherthanthepolicyaddressedatEC9.8424(1)(c) <br />Findings <br />MA202/RA202/Z208 <br /> <br />
