(b) Where the site is adjacent to more than one street, a building is required to meet the <br />above maximum setback standard on only one of the streets. <br /> <br /> <br />Section 6. Subsections (1) and (6) of Section 9.4530 of the Eugene Code, 1971, are amended to <br />provide as follows: <br />9.4530 /TD Transit Oriented Development Overlay Zone Development Standards. <br />(1) Building Setbacks. <br /> <br />(a) Buildings shall be set back a maximum of 15 feet from the street. There is no minimum <br />setback, except as required by EC 9.2170(4)(b). <br /> <br />(b) Where the site is adjacent to more than one street, a building is required to meet the <br />above maximum setback standard on only one of the streets. <br /> <br />*** <br /> <br />(6) Improvements Between Buildings and Streets. The land between a building or exterior <br />improvement and a street must be landscaped and/or paved with a hard surface for use by pedestrians. If <br />hard-surfacing is provided, the area must contain pedestrian amenities such as seating areas, drinking <br />fountains, and/or other design elements (such as public art, planters, and kiosks). The use of porous <br />paving materials for hard surfacing is encouraged. Residential developments are exempt from this <br />requirement, except on properties zoned C-2 or C-3. (See Figure 9.4530(8) Improvements Between <br />Buildings and Streets in /TD Areas.) <br /> <br />Section 7. The findings set forth in Exhibit C attached to this Ordinance are adopted as findings in <br />support of this Ordinance. <br />Section 8. The City Recorder, at the request of, or with the concurrence of the City Attorney, is <br />authorized to administratively correct any reference errors contained herein or in other provisions of the <br />Eugene Code, 1971, to the provisions added, amended or repealed herein. <br />Section 9. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for <br />any reason held invalid or unconstitutional by a court of competent jurisdiction, such portion shall be <br />deemed a separate, distinct and independent provision and such holding shall not affect the validity of the <br />remaining portions hereof. <br />Ordinance - Page 7 of 8 <br /> <br />
