Other relevant, applicable evidence bearing on the nature of seriousness of <br />the violation. <br /> <br />4. In addition to the considerations described at Section 2.018(5) of the Eugene Code, <br />1971, the imposition of penalties for any violation described in this section R-3.250-V shall be <br />based on a formula that calculates the dollar amount of the penalty per day by multiplying the <br />amount of the BASE (subsection a) by the MULTIPLIER (subsection b) and then multiplying that <br />by $20.00 for a licensee or by $10.00 for a customer. Notwithstanding this formula, the maximum <br />assessment for a violation per day shall be $2,000. <br /> <br />a. The BASE is the sum of "E" plus "P" plus "C" plus “T” where: <br /> <br />(1) "E" is the effort made by the responsible person in taking all feasible <br />steps or procedures necessary or appropriate to correct the violation. The value of <br />"E" shall be: <br /> <br />(a) 0, if the responsible person has made an active attempt to <br />correct the violation. <br /> <br />(b) 1, if this is a first violation of the Solid Waste Collection <br />Rate Schedule. <br /> <br />(c) 2, if the responsible person took little or no action <br />whatsoever to correct the violation, or if the violation was so severe as to <br />require immediate civil penalties, or if this was a subsequent violation of <br />the Solid Waste Collection Rate Schedule. <br /> <br />(2) "P" is the frequency of prior violations of ordinances, rules, orders, <br />or permits. The value of "P" is based on prior similar violations for which the city <br />sought voluntary correction or issued an order to correct or a notice of civil <br />violation, regardless of whether enforcement action was taken. The value of "P" <br />shall be: <br /> <br />(a) 1, if the present violation is the first violation by the <br />responsible person. <br /> <br />(b) 2, if the responsible person has had previous violations but <br />none similar to the present violation within the past two years. <br /> <br />(c) 3, if the person responsible has had only one violation <br />similar to the present violation within the past two years.
