Act, the Toxic Substances Control Act, and the Marine Protec- <br />ti on, Research and Sanctuaries Act or regulations promulgated <br />by the city manager. <br />Mobi 1 e waste hauler. A person who, by contract or otherwise, <br />.collects wastewater, i nc1 udi ng domestic waste and septage waste, <br />for transportation to and discharge into any portion of the city <br />sewerage system. <br />Mobi 1 e waste hauler ermi t. A permi t issued pursuant to sec- <br />6.44o of this code. <br />NPDES ermit. National Pollution Discharge Elimination System <br />permit issued pursuant to ORS 4b8.740 and the Act. <br />New si nificant industrial user. Any person discharging from <br />any building, structure, facility or installation source}, the <br />construction of which co~nenced after the publication of proposed <br />pretreatment standards under section 3o7~c} of the Act which will <br />be applicable to such source i f such standards are thereafter pro- <br />mul gated i n accordance with that section, provided that: <br />~a} The building, structure, faci 1 i ty or installation <br />i s constructed at a si to at which na other source i s 1 ocated; <br />or <br />fib} The bui 1 di ng, structure, facility or instal 1 ati an <br />totally replaces the process or production equipment that <br />causes the discharge of pollutants at an existing source; ar <br />~c} The production of wastewater generating processes <br />of the building, structure, facility or installation are sub- <br />stantially independent of an existing source at the same site. <br />I n determining whether these are substantial 1 y independent, <br />factors such as the extent to which the new facility i s i me - <br />grated with the existing plant, and the extent to which the <br />new faci 1 i ty i s engaged i n the same general type of activity <br />as the existing source should be considered. <br />Construction an a site at which an existing source is located re- <br />sul is i n a modi f i cati on rather than a new source i f the construc- <br />t i on does not create a new building, structure, faci 1 i ty or i n <br />stal 1 ati on meeting the criteria of paragraphs fib} or 4c} of thi s <br />paragraph but otherwise alters, replaces, or adds to existing pro- <br />cess or production equipment. Construction of a new source as de- <br />fined under this paragraph has commenced if the owner or operator <br />has: <br />~d} Begun, or caused to begin as part of a continuous <br />onsi to construction program: <br />1. Any placement, assembly, or installation of <br />facilities or equipment ; yr <br />2 . Significant site preparation work including <br />ci eari ng, excavation, or removal of existing bui 1 di ngs, <br />structures, or facilities which is necessary for the <br />placement, assembly, or installation of new source <br />facilities or equipment; or <br />~ e } Entered i nto a bi nd i ng contractual obligation for <br />the purchase of faci 1 i ti es or equipment which are intended to <br />be used i n its operation wi thi n a reasonabl a time.
