A person may appeal to the board when the person <br />claims that the city has denied, suspended or revoked a permit <br />based an the appl i cat i an of the techn i cal codes, or that the <br />city has misinterpreted the true intent of a techn i cal code . <br />The owner of a building or structure or property also may <br />appeal from a decision of the city manager refusing to grant <br />a modi f i cat i an to the prov i s i ins of a techn i cal code covering <br />the design or method of construction or materi a1 to be used i n <br />the erection, a1 terati on, or repair of the bui 1 di ng or struc- <br />ture or bui 1 d i ng service equipment when i t i s the app] i cant's <br />bet ief that he/she has proposed an equally good or better <br />material or method of construction ar installation than that <br />required by a technical code. <br />3. Membershi of construction code board of a eal s. <br />The construction code board of appeals shall consist of eight <br />~8} members nominated by the mayor and appai nted by the <br />council. The eight board members shall consist of: a licensed <br />professional engineer, architect, bui 1 di ng contractor or sup- <br />eri ntendent of bui 1 di ng construction, electrical contractor, <br />an Oregon 1 i censed engineer with electrical speciality, p1 umb- <br />i ng contractor, mechanical ~heati ng and venti l ati one contrac- <br />tor, and Oregon 1 i censed engineer with mechanical speciality. <br />The city manager or designees, shal 1 be ex of f i c i a members of <br />the board. <br />Section 5. The City Recorder, at the request of, or with the concur- <br />rence of the City Attorney, i s authori ted to administratively correct any <br />reference errors cantai ned herein, or i n other provisions of the Eugene Code, <br />1911, to the provisions added, amended, or repealed herein. <br />Section fi. Notwithstanding the effective date of this Ordinance, the <br />provisions contained i n Section 4 of this Ordinance changing the composition <br />of the Construction Code Board of Appeals shall become effective upon the <br />expiration of two of the current journeyman positions on December 31, 1992, <br />or upon any of the current three journeyman positions becoming vacant, which- <br />ever first occurs. <br />Section 1.
