ORDINANCE NO. ~ ~ Y~ <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF <br />PROCEEDINGS IN EMINENT DOMAIN FOR THE <br />ACQUISITION BY CONDEMNATION OF CERTAIN <br />INTERESTS IN REAL PROPERTY TO ALLOW <br />CONSTRUCTION OF LOw INCOME HOUSING; AND <br />OTHER PUBLIC USES AND DECLARING AN <br />EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />A. The City council has authority under provisions of the City Charter and <br />applicable state law, including but not limited to its powers as a housing authority under <br />CRS Chapter 45b, to institute proceedings in eminent domain for the ac uisition b <br />q Y <br />condemnation of private property for public purposes, including uses associated with <br />providing housing for low income tenants through rent subsidy programs. <br />B. Since 1989 providing and promoting low-income housing within the City has <br />been a priority social goal for the City. <br />C. In establishing the low-income housing social goal and since its adoption, there <br />has been substantial documentation that there is a shortage of affordable housing within the <br />City for people with low income. <br />D. Law income families with children are among the highest priority to provide <br />housing. <br />E. The City has owned the site described in Exhibit A hereto for over ten years <br />and over twa years ago placed it in the City's land bank for low income housing. <br />F. The site is particularly suitable for low income housing for families because of <br />its proximity to public transportation, shopping, public schools and employment opportunities <br />and because of the availability of utilities and the ability to replat the site. <br />G. The old covenants, conditions and restrictions imposed upon the site at the <br />time of its subdivision and replatting limit the City's ability to develop the property to its <br />maximum as a low income housing project. <br />H. The City in cooperation with Lane County has a present opportunity to <br />develop part of the property City awns within the Subdivision with 31 units of low-income <br />family housing. <br />Ordinance -1 <br />
