ORDINANCE NO.19853 <br />AN ORDINANCE ADQ~~TING ~~3E. `~'~~ST EUGENE <br />WETLANDS SPECS AREA STT~~~I , <br />The City Council of the City of Euge~ae finds that: <br />A. In January 1989, the Eugene Planning Commission began work on the West <br />Eugene Wetlands Special Area Study ~Stu~r~. The Study is a multi le ob'ective <br />. P J <br />exam~nat~on of the balance between protec~i~n of valuable wetland areas and water <br />quality, and preservation of developable laid within the Stud area~~west Eu ene. <br />Y g <br />B. Section 444 of the Federal Clean '4~ater Act X33 U.S.C. 1344 and the Ore on <br />~ g <br />Revised Statutes, 196.~~Q-19b.99~, regulate fill and development within wetlands in order <br />to protect water quality. <br />C. For citizen involvement the Study relied upon a series of five public worksho s <br />P <br />attended by a total of approximately 475 people. Numerous presentations were made <br />during the preparation of the Study to elected and appointed public bodies and to local <br />civic, development and environmental groups and organizations. Numerous field tri s to <br />P <br />the wetlands were conducted for federal, state and local government agencies and local <br />organizations. Comments were received and recorded from each of the worksho s, the <br />. P <br />presentations and the f~e1d trips. <br />D. Throughout the Study process the owners of every parcel containing wetlands <br />identified in the Study were included on a mailing list, and were notified of all worksho s, <br />• ~ p <br />public meetings and hearings, and were given general informat~an about the Study via a <br />newsletter. <br />E. A technical advisory committee ~TAC} comprised of representatives from the <br />U.S. Environmental Protection Agency, the U.S. Army Corps of Engineers, the U.S. Fish <br />and Wildlife Service, the Oregon Division of State Lands and the Oregon De artment of <br />. .. P <br />Environmental Quality part~c~pated ~n the development of the draft plan and commented <br />on the draft plan after it was distributed far public review. <br />F. In March 1991, the initial draft of the Nest Eugene Wetlands Special Area <br />Study was distributed far public review. The Eugene Planning Commission s onsored a <br />P <br />public information session an May 3 and 4, 1991 to generate comments concernin the <br />g <br />draft Study findings and recommendations. Comments received at the information session <br />along with comments received from the workshops, presentations and field tri s were <br />. P <br />forwarded to the Planning Camm~ss~on, <br />G. The Eugene Planning C4mrnissian conducted a joint public hearing in c~njunc- <br />Ordinance - 1 <br />
