ORDINANCE N0. r~1s st <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF PROCEEDINGS <br />IN EMINENT DOMAIN FOR THE ACQUISITION OF PROPERTY <br />INTERESTS ALONG 11TH AI~ENUE WEST FROM GARFIELD STREET TO <br />TYINN STREET, FOR THE PURPOSES OF CONSTRUCTION OF STREET <br />IMPROVEMENTS; AND DECLARING AN EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />The City Council has authority under provisions of the City Charter and <br />applicable state 1 aw to institute proceedings i n eminent domain for the ac u i s i <br />q <br />ti on of private property for public purposes, including the improvement of ci t <br />y <br />streets and canstructi on of curbs, gutters, sidewalks, traffic signals and other <br />features. <br />By Council adoption the City's Capital Improvement Plan the City of Eu ene <br />g <br />initiated the I 1 th Avenue West Improvement Project from Garfield Street to T inn <br />Y <br />Street, which includes street improvements consisting of paving, curbs, utters <br />g <br />sidewalks and traffic signa] improvements. <br />The proposed improvements shall be in compliance with, and in furtherance <br />of, the plans and specifications to be prepared by the City En ineer in <br />g <br />accordance with provi s i ans of Chapter 1 of the Eugene Code, 1971, and a i i cabl e <br />pP <br />policies of the City of Eugene, <br />Development and increased traffic nvw necessitate widening and im rovin <br />p 9 <br />the public way to serve the adjacent property, the surroundin nei hbarhood and <br />g g <br />through traffic. <br />It is nvt in the public interest to significantly relocate this historic <br />arterial street. The least private harm will be done by expanding the width of <br />the existing public way to accommodate the project as proposed and re ared b <br />P P Y <br />the City Engineer. <br />The casts of delaying the project, the savings from efficient construction <br />management techniques, and the need to facilitate the safe and efficient movement <br />
