2.3 Send a notice of the reduced assessment to the <br />owners .of the affected property. Send notice as required by EC <br />7.230 to the current owners of affected parcels accompanied by a <br />refund check to the owners where the assessment was paid in full, <br />or accompanied by notice of a credit applied to the assessment <br />accounts for the parcels where the. owner elected to pay the <br />assessment in installments and there remains an unpaid balance. If <br />the application of a credit results in aver-payment of a n <br />assessment account, the excess shall be returned to the current <br />owner of the parcel unless the owner is delinquent in the payment <br />of another special benefit assessment. if the owner is delinquent, <br />the excess credit shall be applied to the delinquent account, <br />provided, however, that such payment shall not cure any delinquency <br />or cause prevent the City's pursuit of any remedy it may have to <br />collect the delinquency. <br />Section 3. Except as herein specifically amended, all other <br />provisions of ordinance 19924 and the assessments provided for <br />therein remain in full force and effect . <br />Section 4. That the matters contained herein affect the <br />public welfare and safety and therefore, an emergency is hereby <br />declared to exist, and this ordinance shall became effective <br />immediately upon its passage by the City Council and approval by <br />the Mayor, retention by the Mayor for mare than ten days, or <br />readoption over a mayoral veto by two-thirds of all members of the <br />Council. <br />ORDINANCE - 3 <br />
