ORDINANCE N0. 19935 <br />AN ORDINANCE REGARDING THE CALCULATION OF REMONSTRANCES FOR LOCAL <br />IMPROVEMENT DISTRICTS; AMENDING SUBSECTION 1.lfifi€2} OF THE EUGENE <br />CODE, 1971; AND DECLARING AN EMERGENCY. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Subsection 1.16fi~2} of the Eugene Code, 1911 is hereby amended <br />to provide: <br />1.1fi6 loc 1 Im rovements -Hearin an Im rovement. <br />~ ~ } when the hearing required by subsection 1.166 ~ 1 } i s conducted <br />by the counci 1's designee, i f, without regard for any counci 1 subsidy policy, the <br />owners of property that would bear mare than hal f the amount estimated to be <br />assessed to finance the ~ mprovement or repair of a street or alley remonstrate, <br />the counci 1's designee shall continue the hearing to a counci l meeting and direct <br />the city engineer to send by first-class mai l a noti ce to the owners of the <br />affected property stating the date, time and place of the counci 1 meeting when <br />the proposed improvement and the remonstrance wi l 1 be considered. As used i n <br />this subsection "subsidy policy" means a policy specifically designated as a <br />subsidy program and not other council policies dealing with the allocation of <br />local improvement costs. <br />Section 2.
