ORDINANCE N0. L°i`i4`3 <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF <br />PROCEEDINGS IN EMINENT DOMAIN FOR THE <br />ACQUISITION OF PROPERTY INTERESTS EAST OF <br />ORR LANE AND SOUTH OF 23RD AVENUE FOR THE <br />PURPOSE OF ACCESSING AND MAINTAINING STORM <br />DRAIN FACILITIES. <br />The City Counci ~ of the C1 ty of Eugene finds that <br />The City Council has authority under provi s7 ons of the City Charter <br />and applicable state 1 aw to institute proceedings i n eminent domain for the <br />acquisition by condemnation of private property for public purposes , including <br />rights of access to provide for maintenance of city drainage facilities. <br />Under the City's Storm Drainage Master Plan and the Public Works <br />Maintenance Division Storm Sewer Maintenance Policy, the City routi nely mai ntai ns <br />several natural waterways and storm sewer inlets . This maintenance service i s <br />provided i n the Public's interest to assure that the storm sewer systems are <br />properly maintained to allow cal 1 ecti on , channeling and disposition of the storm <br />water to avoid flooding of adjoining properties . Each year heavy rains and <br />runoff have caused a storm sewer inlet grate 1 acated near the end of Orr Lane to <br />plug with debris . The resultant flood? ng has required Public Works Maintenance <br />personnel to c1 ear the grate ante or twice per year. <br />Having 1 egal and ready access to the storm sewer i n1 et east of orr <br />Lane and south of 23rd Avenue wi l 1 enhance the City's obi 1 i ty to plan and <br />schedule equipment and staff needed for routine and emergency maintenance. <br />With the seasonal rainy weather approaching , increased storm water <br />runoff wi l 1 create the need for adequate maintenance for the i n1 et , requiring the <br />City to act promptly to acquire the necessary property interests far the access <br />easement . Alternative sot uti ons have been reviewed , however , the existing system <br />i s most e~ecti ve given the setting and overall community cost . <br />Ordinance - 1 <br />
