ORDINANCE N0. 1 ~~ ~~ <br />AN ORDINANCE AUTHORIZING THE INSTITUTION OF <br />PROCEEDINGS IN EMINENT DOMAIN FOR THE <br />ACQUISITION OF PROPERTY INTERESTS IN GLEN- <br />WOOD FOR THE PURPOSES CONSTRUCTION OF <br />SANITARY SEWER IMPROVEMENTS. <br />The City Council of the City of Eugene finds that: <br />The City Council has authority under provisions of the City Charter <br />and applicable state 1 aw to institute proceedings i n eminent domain for the <br />acquisition by condemnation of private property for public purposes , including <br />the construction maintenance of sanitary sewers. <br />The City of Eugene i s i n the process of designing sewers for the <br />Gl enwoad Area i n conformity with the Sanitary Sewer Master Plan . On March 1, <br />1993, the Counci 1 approved the '94 fiscal year Capital Improvement Projects ~CIP~ <br />which included the design of the Glenwood sanitary sewer/pump station and <br />acquisition of needed rights -of -way . <br />The proposed improvements shall be in compl lance with, and in <br />furtherance of , the plans and specifications to be prepared by the City Engineer <br />i n accordance with provisions of Chapter 7 of the Eugene Code, 1911, and <br />applicable pot i ci es of the City of Eugene . <br />In determining the 1 ocati on of the easements and rights-of-way to be <br />acquired, consideration was given to avoiding existing structures and nature <br />trees ; to minimizing the costs of constructing, maintaining and operating the <br />proposed sanitary sewer improvements ; to minimize disruption to existing vacant <br />areas that could develop i n the future by 1 ocati ng the easements a1 ong 1 of lines <br />or i n private ways of ingress and egress ; and to selecting 1 ocati ons for the <br />proposed sanitary sewer that were the most direct, thereby reducing the costs of <br />construction . <br />
