BEFORE THE CITY COUNCIL 4F THE CITY 4F EUGENE, OREGON <br />Final Order i n Z 93-37 <br />The City Council of the City of Eugene finds. <br />1. 4n October 14, 1993, the following application for a change in zone <br />was submitted. <br />GMD Investments (Jerry's Home Improvement Center) <br />(Z 93-37) <br />Tax Lots 20o through 1300, 1404 tpartian}-- <br />Assessar's Map 17--04--16-11; Tax Lots 2200, 2500 <br />through 2804----Assessor's Map 17-04--16-11 <br />Located west of E1 ~ zabeth Street, between Theona <br />Street and Bel tl i ne Highway <br />Requests rezoning from RA/UL Suburban <br />Res ident i al /Urban i zabl a Land to I--2/UL Light-Medium <br />Industrial /Urbani zabl a land, Processed <br />concurrently with MA 93-1. <br />Applicant: GMD Investments <br />2. The application was initiated and submitted i n accordance with <br />Section 9.612 of the lane Code for the Urbanizabie Area, 1981. Time]y and <br />sufficient . nati ce of the zone change has been provided. <br />3. Un February 8, 1994, the City Council held a public hearing on the <br />zone change. The Pi anni ng Division staf f notes as approved by the Planning <br />Commi ssi an, the Pi anni ng Commission decision and recammendati on, and the oral <br />and written testimony presented have been considered and are part of the <br />record of this proceeding. <br />4. Further consideration has been given to the Eugene-Spri ngf i e1 d <br />Metropolitan Area General Pi an and ai 1 appl i cabi a speci a1 purpose and func-- <br />tianal pi ans, pi anni ng rei ated pot i ci es, and community pi ans as set forth on <br />pages 1-5 and 1-6 of the Metropolitan Pian. <br />5. 4n the basis of the record, the City Counci i of the City of Eugene <br />finds that the zone change i s cans i stent with the criteria set forth i n <br />Section 9.6T8~2y of the Lane Cade for the Urbanizabie Area, 198T. This <br />general finding i s supported by the specific findings of fact and conclusions <br />of 1 aw set out i n Exhi bi t B to this order, which are adopted herein. <br />Now, therefore, based upon the above findings and the record i n thi s <br />proceeding, the City Counci i approves the P1 anni ng Commission decision and <br />recommendation, and i t i s hereby ordered that: <br />
