ORDINANCE NO. 1998'2 <br />AN ORDINANCE CONCERNING SOLID WASTE AND RECYCLING; <br />AMENDING SECTIONS 3.245, 3.241, 3.250, 3.2fi0, 3.210, <br />3.212, 3.215, AND 3.282 OF THE EUGENE CODE, 1911; AND <br />ADDING A NEW SECTION 3.080 TO THAT CODE. <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Subsection ~1} of Section 3.245 of the Eugene Code, 1911, is <br />amended to provide <br />. _. ' __ _ y ,~, ~ i ng -License Required . <br />S o_ __ _~ Waste a n _ R,e c' c , ~~...._„ ~_~.~~~.,,,.~~,~~~.~.~,~~~~.~.~..., <br />~1} No person shall operate as a residential recycling collector <br />ar solid waste collector within the corporate 1 i mi is of the city wi thaut first <br />obtaining a collection license for such activity. <br />Section 2. Section 3.241 of the Eugene Code, 1911, is amended to provide: <br />3.241 Solid Waste and Rec clin -Limitation on Number of Solid Waste <br />Collection licenses. <br />~ 1 } Licenses for the col 1 ecti on of sal id waste shal 1 be i sued only <br />to those licensees currently providing solid waste collection service in the <br />city. <br />~2} Additional 1 icenses for the collection of sol id waste shall be <br />issued only upon a showing by the applicant of the need for such service in the <br />city. The decision of the city manager or the city manager's designee on such <br />applications shat 1 be based on criteria consisting of , but not 1 i mi ted to: <br />~a} Increase in city population; . <br />fib} Extension of city boundaries; <br />~c} Increase of intensive residential, commercial or <br />industrial development within the city boundaries; <br />~d} Changes . i n solid waste technology and/or recycling <br />call ect i on technology which could material 1 y improve col 1 ecti on <br />service or reduce col 1 ecti on costs to city residents; <br />fie} Changes in federal and/or state laws, rules or <br />regulations which materially affect solid waste Dr recycling <br />col 1 ecti an requ.i rements; and <br />~ f } Inability of current 1 i censees to adequately handl e <br />increased needs for service. <br />~3} After reviewing the application, the city manager or designee <br />may approve or deny a request ,for an additional 1 icense for the collection of <br />solid waste. No additional limited 1 icenses shall be issued. <br />~4} If a 1 i cense i s termi Hated or forfeited, that l i cense shall not <br />be re-issued and the total number of 1 i censes shat 1 be reduced. <br />Section 3.
