ORDINANCE NO. ~' <br />AN ORDINANCE CONCERNING THE VIDEO DISPLAY <br />GAMBLING DEVICE TAB; AMENDING ORDINANCE NO. <br />19980 TO PROVIDE AN EFFECTIVE DATE; AND <br />DECLARING AN EMERGENCY. <br />The City Council of the City of Eugene finds that: <br />A. Ordinance No.1995owas passed by the Council and approved by the Mayor <br />on September 12,1994 establishing a video display gambling device tax. That Ordinance did <br />not contain an emergency clause, and pursuant to the City Charter and Eugene Code, 19? 1 <br />would became effective on October 12,1994. <br />B. A referendum petition is currently being circulated to refer ordinance No. <br />19950 to the electors of the City, and the Council finds it is in the public interest to provide <br />an effective date of November 1, 1994 for Ordinance No. 19950 and the tax established <br />therein in order to provide circulators of the petitions 30 days within which to gather <br />signatures. <br />Now, therefore, <br />THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: <br />Section 1. Based on the above findings, which are adopted herein, Ordinance No. <br />19950 passed by the Council and approved by the Mayor is amended to provide that the <br />Ordinance, and the tax established therein shall become effective on November 1,1994. <br />Section 2. Pursuant to the provisions of Section 2.971 of the Eugene Code, 1971, a <br />completed referendum petition to refer ordinance No.19950 to the electors of the City must <br />be filed with the City Recorder no later than 5:00 p.m. on October 31,1994. <br />Section 3. In the event a completed referendum petition is filed and certified, the <br />effective date for imposition of the tax as set forth in Ordinance No. 19980 as amended <br />herein, shall be postponed pending the action of the Council pursuant to Section 2.950 of <br />the Eugene Code, 1971 or the election held pursuant to Section 2.951 of the Eugene Code, <br />1971. <br />Section 4. The City Recorder is requested administratively to change the reference <br />to October 1, 1994 set forth in Section 3.702 as adopted by Ordinance No. 19950 to <br />November 1,1994. <br />Section 5. Notwithstanding any contrary provision of the Eugene Code, 1971, no <br />Ordinance -1 <br />
