Further such acquisitions would require <br />substantially mare public dollars than the acquisitions herein approved, <br />Any proposed improvements shall be in compliance with, and in furtherance of, plans and <br />specifications to be prepared by the City Engineer in accordance with provisions of Chapter 7 of the <br />Eugene Code, 1971, and applicable policies of the City of Eugene. <br />Extending the Fernridge Bike path at this time is necessary to serve the community and to <br />continue compliance with the Bicycle Element of the Eugene-Springfield Metropolitan Area <br />Transportation Plan. <br />The cost of delaying the acquisition prof ect, the savings from efficient management techniques, <br />the need to facilitate the safe and efficient movement of bicyclists and pedestrians, and to meet the <br />federal grant conditions for const~.iction, requires the City to act promptly to acquire the necessary <br />property interests for this prof ect. <br />NGW, THEREFGRE, THE CITY OF EUGENE DOES GRDAIN AS FGLL4WS: <br />Section 1. Based upon the above findings, which are incorporated herein by reference and <br />hereby adopted, the City Council of the City of Eugene does hereby fznd, declare, and determine it <br />necessary to acquire certain ownership interests in portions of the parcels of real property more <br />particularly described on Exhibit A attached hereto and incorporated herein by reference in order to <br />properly maintain and enhance improvements to Amazon Creek between Beltline Road and Southern <br />Pacific Railroad near Terry Street including drainage enhancements, maintenance access, public <br />bike and pedestrian path improvements and other features. All to be constructed in accordance with <br />plans and designs prepared by the City Engineer and approved by the City Manager. <br />Section 2. The City Council does hereby direct that the City of Eugene shall institute <br />negotiations with affected owners to acquire needed property and institute proceedings in eminent <br />
