maps are in error. <br />~4} Canveyance of stormwater maintenance easement, Within the <br />waterside protection area, the city shall have the authority to require <br />conveyance of a mai ntenance access easement for any natural or human made <br />stormwater foci 1 i ty as a condi ti on of approval for any site review yr condi ti anal <br />use permit. Maintenance access easements shall be paral 1 el to the stream ar <br />channel and shall be of sufficient width to al 1 ow a 2a foot wide maintenance <br />access road along one side of the stream or channel. <br />~5} Permitted uses. There are two categories of uses: those <br />allowed by the parent district outside of the waterside protection area, and a <br />mare restrictive 1 i st al l awed within the waterside protection area. <br />~ a} Uses permitted or permitted cond i t i ona11 y i n the parent <br />district are permitted within this sub-district provided those uses <br />are located outside waterside protection areas. <br />fib} Uses ermitted outri ht. Within waterside protection <br />areas, the fol 1 owi ng uses are permitted, subject to the "Prohibited <br />practices" provisions in subsection ~6} of this section: <br />l . Removal of refuse and unauthorized f i 11. <br />2. Removal of non-native or invasive plant species <br />i nc1 uded on a 1 i st determined by the P1 ann i ng Director and <br />kept an f i 1 e at the city. <br />3. P1 anti ng or rep1 anti ng with native plants i nc1 uded <br />on a 1 i st determined by the P1 ann i ng Director and kept on f i 1 e <br />at the city. <br />4. Construction of channel maintenance access roads <br />yr pathways and channel maintenance practices used to mai ntai n <br />stormwater conveyance and flood control capacity as required <br />by local policies, state and federal regulations, and <br />intergovernmental agreements. <br />5. Removal of vegetation by non-chemical means wi th i n <br />a strip not to exceed ~ 5 feet wide where a pub1 i cl y owned <br />property within the waterside protection sub-district abuts <br />private property that is not within a waterside protection <br />area, only when deemed necessary by the public works director <br />or designee to protect human health and safety or to prevent <br />a nuisance. <br />~c} Uses permitted sub.iect to site o1 an review. Wi thi n <br />waterside protecti on ~ areas, the fol 1 owi ng uses are permitted, <br />subject to the "Prohibited practices" provisions i n subsection ~6} <br />of this sect i an and site plan approval based upon compliance with <br />the natural resources special standards from section 9, 305 1 i steel <br />with each use below: <br />1. Construction of stormwater quality treatment <br />foci 1 i ti es that use bi of i 1 trot i on methods, such as shallow <br />grassy swales, constructed wetlands, and ponds, and which do <br />not include adding impervious surfaces.
