<br />ORDINANCE NO. <br /> <br />~60C;3 <br /> <br />AN ORDINANCE LEVYING ASSESSMENTS FOR <br />INSTALLATION OF CURBS AND GUTTERS, SIDEWALKS AND ACCESS <br />DRIVES ALONG HIGHWAY 99 (PACIFIC HIGHWAY WEST) FROM <br />BARGER DRIVE TO ROOSEVELT BOULEVARD; AND DECLARING AN <br />EMERGENCY. (CONTRACT 94-S06) (JOB #2728) <br /> <br />The City Council of the City of Eugene finds that: <br /> <br />A. In May,1991, the City Council through adoption of the <br /> <br />Capital Improvement Program (CIP) , authorized staff to proceed with <br /> <br />the initiation of the design and bidding of the proposed local <br /> <br />improvement project consisting of the installation of curbs and <br /> <br />gutters, sidewalks, and access drives along Highway 99 (Pacific <br /> <br />Highway West) from Barger Drive to Roosevelt Boulevard, in <br /> <br />accordance with Subsection 7.160(5) of the Eugene Code, 1971 (EC), <br /> <br />and to enter into a Cooperative Improvement Agreement with the <br /> <br />Oregon Department of Transportation (ODOT) and Lane County. <br /> <br />B. After due notice and a public hearing thereon before the <br /> <br />hearing official, and no remonstrances having been filed, on the <br /> <br />7th day of March, 1994, the City Council formed the local improve- <br /> <br />ment district and authorized construction of the local improvement. <br /> <br />c. The cost of the local improvement is ascertained to be <br /> <br />approximately $1,620,000 and the amounts to be assessed to and <br /> <br />borne by the specially benefitted property and to be borne by the <br /> <br />Ordinance - 1 <br />
