of this new parking structure at loth and Pearl to fulfill the <br />parking mitigation needs far Lane Community College has been <br />approved by the City Council and LCC and LTD have concurred. <br />Construction of the new public. facility will enable the <br />simultaneous construction of a similar privately-~owned parking <br />structure across the street at the northwest corner of 14th and <br />Pearl. The two new structures w~.ll divert parking demand from the <br />overpark, thereby freeing up spaces in the overpark to mitigate the <br />loss of surface parking at the terminal site. <br />B. Evaluation <br />Modification of a conditional use permit approval requires a <br />finding that the modification meets the applicable criteria of <br />Section 9.702 of the Eugene Code. <br />Those criteria are: <br />Sect~.on 9.702 a The location, size, design, and <br />operating characteristics of the proposed development <br />are such that it can be made reasonably compatible with <br />and have minimal impact on the livability or the <br />appxapriate development of abutting properties and the <br />surrounding neighborhood, with consideration to be given <br />to harmony in sca~.e, bulk, coverage, and density; to the <br />availability of public facilities and utilities; to the <br />generation of traffic and the capacity of surrounding <br />stzeets, and to other relevant impacts of the <br />development. <br />Section _9_._702~b~ : The location, design, and related <br />features of the proposed development will provide a <br />convenient and functional living, working, shopping or <br />civic environment, and will be as attractive as the <br />nature of the use and its location and setting warrant. <br />Section 9.702 ~c~: The proposed ~ development will be <br />consistent with applicable adopted neighborhood <br />refinement plans, special area studies, and functional <br />plans. <br />S,ect,ion ___9.7o2_~d~_: The proposed development will be <br />consistent with the Metropolitan Area General. Plan 1} <br />applicable land use references; 2} text related to the <br />development, and 3} specific elements related to the <br />development. <br />The findings on each criteria remain unaltered by the modif i.cation <br />request.
