Notice <br />given in any manner other tb~an the manner set forth above shall be effective when received by <br />the party far whom it is intended. <br />7. Representations. LTD agrees that it acquires the Property "As Is." In making and <br />executing this Agreement, and in closing this transaction, LTD has not relied upon or been <br />induced by and will not rely upon or be induced by any statements or representations by Agency <br />or City or any agent of Agency or City with respect to the physical condition of the Property, <br />including any environmental conditions or hazardous substances or materials present on or below <br />the surface of the Property or of any other mater affecting or relating to the physical condition <br />of the property or the corners or boundaries thereof, The provisions of this Paragraph 7 bar all <br />claims of LTD against Agency or City concerning the condition of the Property. Effective at <br />closing, LTD waives, releases and forever discharges Agency or City and any person acting on <br />behalf of Agency or City, of and from any and all claims, actions, causes of action, damages, <br />costs direct or indirect, known or unknown, foreseen or unforeseen, which may arise on account <br />of or in any way growing out of or in connection with any physical characteristic or condition <br />of the Property, including without limitation any sub-surface condition or hazardous substance <br />or material on, under or related to the Property or any law or regulation applicable thereto. <br />This waiver shall incline, without limitatran, any claim .based on. 42 USC Section 9b01 et seq. <br />~CERCLA~, SRS ~ 4b5.ZOO et seq., and any other federal, state vr. local law or regulation <br />. addressing environmental Taws. ~~ .~.. .. -~ . ~ ... .. . <br />7.1 LTD makes the representations contained in this Paragraph 7 after making its own <br />examination and inspections of the Property. <br />Page 6 - INTERGGVERNMENTAL AGREEMENT <br />
