ADMINISTRATIVE ORDER NO.58-22-18 <br />of the <br />Executive Director of the Public Works Department <br />EXTENDING THE TEMPORARY CLOSURE OF A PORTION OF SCOBERT <br />PARK ENABLED BY ADMINISTRATIVE ORDER NO.58-20-09. <br />The Executive Director of the Public Works Department finds that: <br />Pursuant to the authority of Administrative Order No.21-03-12 issued by the City <br />Manager,the Executive Director of the Public Works Department is authorized to regulate City <br />parks,protect park visitors and the park environment,and adopt rules regarding the use of parks. <br />Section 1 .003 of the Parks and Open Space Rules authorizes the temporary closure <br />of all or any portion of a park,open space,or facility upon finding that conditions that threaten the <br />welfare or safety of nearby residents exist and the need to preserve their welfare and safety <br />outweighs the public's right of access to the park,open space and/or facility. <br />On April 16,2010,Administrative Order No.58-10-04 was issued closing a portion <br />of Scobert Park,located at 1180 West 4th Avenue,effective 12:01 a.m.on April 23,2010 until <br />April 22,2012.The closure has subsequently been extended,most recently by Administrative <br />Order No.58-20-09,which extended the temporary closure until April 22,2022. <br />A. <br />B. <br />C. <br />The above-mentioned portion of Scobert Park became a haven for illegal activities <br />creating an atmosphere that threatened the welfare and safety of the residents in the area.Prior to <br />its closure,efforts to curtail the illegal activities,including the fencing of the area,were <br />unsuccessful.Therefore,it was necessary to close the portion of Scobert Park,and it is necessary <br />that it remain closed until funds are available to redesign the Park. <br />D. <br />E.The need to protect and preserve the welfare and safety of residents living nearby <br />Scobert Park outweigh the public's right of access to the fenced portion of Scobert Park. <br />NOW,THEREFORE,based on the above findings,I order that: <br />The closure of the portion of Scobert Park,located at 1180 West 4th Avenue, <br />delineated by a black wrought iron fence erected by the City,is extended and shall be closed to <br />entry by all persons other than police officers,authorized City employees and persons with written <br />authorization from the Public Works Director or the Parks Maintenance Manager until April 22, <br />1. <br />2024. <br />In addition to any other measures that may be implemented to ensure that entry to <br />the closed portion of Scobert Park is restricted,the City shall maintain fences or other barriers <br />2. <br />Administrative Order -Page 1 of 2
