<br />RESOLUTION NO. 4776 <br /> <br />A RESOLUTION ADOPTING UPDATED METROPOLITAN <br />WASTEWATER MANAGEMENT COMMISSION <br />REGIONAL SEWERAGE SYSTEM DEVELOPMENT CHARGE <br />UNIT COSTS AND REFERENCE DATA, AND AMENDING <br />RESOLUTION NO. 4740. <br /> <br />The City Council of the City of Eugene finds as follows: <br /> <br />A. On September 23, 2002, the System Development Charges (SDC) Methodologies <br />were adopted by Resolution No.4 7 40. Resolution No.4 7 40 remains in effect except as amended by <br />Resolution No. 4748 on January 27,2003, Resolution No. 4767 on July 28,2003, Resolution No. <br />4768 on July 28,2003, and Resolution No. 4770 on August 11,2003. <br /> <br />B. The Metropolitan Wastewater Management Commission (MWMC) methodology for <br />determining the system development charges for new development that is to be connected to the <br />regional sanitary sewer system allows for the unit costs and reference data upon which the charge is <br />to be based to be adjusted from time to time as directed by the MWMC or its Executive Officer <br />without going through the process required to amend the methodology. In accordance with these <br />provisions, the unit costs and reference data are adjusted annually. <br /> <br />C. The MWMC has requested that both the City of Eugene and the City of Springfield <br />adopt the updated unit costs and reference data set forth in Exhibit A attached hereto. The City of <br />Springfield has already done so. <br /> <br />D. The City of Eugene' s SDC Methodologies, section 2.4, provide that increases in SDC <br />fees based on periodic application of a specific cost index or rate factor incorporated in the <br />Methodologies may be made administratively ifthe increase is less than five percent within any 12- <br />month period. Fee increases exceeding five percent must be adopted by resolution of the City <br />Council. The increase requested by the MWMC exceeds five percent. <br /> <br />NOW, THEREFORE, based upon the above findings, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a <br />Municipal Corporation of the State of Oregon, as follows: <br /> <br />Section 1. The City Council hereby adopts the updated Metropolitan Wastewater <br />Management Commission Regional Sewerage System Development Charge Unit Costs and <br />Reference Data attached hereto as Exhibit A. <br /> <br />Section 2. Updates to the rates as set out in Section 1 result in changes to the Regional <br /> <br />Resolution - 1 <br />
