September 26, 2005

Eugene City Council
clo Eugene Planning Division
Attn: GoalS Testimony
90 West 10th Avenue
Eugene OR 97401

-
RECEIVED
SEP 2 6 2005
CITY OF EUGENE
PLANNING DEPARTMENT

Councilmembers:

We have been fighting the proposed Goal 5 overlay zone affecting our home at
999 Lorane Highway since 2003. We are outraged that 80 feet of our property is
now being considered for setbacks to allegedly protect an already-protected
drainage ditch that runs through the property. This ridiculous proposal for our
less-than-acre parcel of land is almost half the protection proposed for the
Willamette River (100' either side)!

In our case, the site area surrounding the drainage ditch has been developed and
landscaped, including a pedestrian bridge. There is also an exposed sewer line
crossing the ditch, not exactly conducive to wildlife. This ditch has only seasonal
water in it and none when it is needed to support wildlife. Of greatest personal
concern, however, is what an 80' setback will do to the property value of our
home and to our use and enjoyment of our own property.

We feel deceived by Sr. Planner Neil Bjorklund and Associate Planner Ann
Siegenthaler, who some time ago gained access to our property when we
requested to be considered for exclusion from the Goal 5 project due to our
unique circumstances. Three people present heard Mr. Bjorklund state that if not
excluded, the setback for us would probably be in the neighborhood of 20 feet on
either side of the ditch, as was the case with the majority of the properties
involved. Now the proposal is double that, to 80 feet of our property!

We are environmentalists ourselves, but again, are horrified that our individual
property rights are being ignored through this process under the guise of
"environmental/wildlife protection."

Please don't allow this "overlay zone" injustice to occur. Please vote against an
80' setback on our already-protected property. Thank you for your consideration
o position.

4"~~~~
. nd Bonnie Chappa ~-;77'/~
999 Lorane Hwy.
Eugene OR 97405
phone 686-0833
