<br />ATTACHMENT B <br /> <br />Exhibit E <br />Legislative Findings <br />to Ordinance No.--1!l <br /> <br />Adoption of New Refinement Plan The following criteria are applicable to the adoption of <br />a new refinement plan. <br /> <br />(1) The refinement plan amendment is consistent with the Statewide planning goals. <br /> <br />Goal 1 Citizen Involvement: To develop a citizen involvement program that insures the <br />opportunity for citizens to be involved in all phases of the planning process. <br /> <br />The City has acknowledged provisions for citizen involvement that ensure the opportunity for <br />citizens to be involved in all phases of the planning process and set out requirements for such <br />involvement. The action taken did not amend the citizen involvement program. The process for <br />adopting these amendments complied with Goal 1 since it complied with, and surpassed the <br />requirements of, the citizen involvement provisions. <br /> <br />The City of Eugene land use code implements Statewide Planning Goal 1 by requiring that <br />notice of the proposed amendments be given and public hearings be held prior to adoption. <br /> <br />The process for adopting a Goal 5 Inventory for the area within the Eugene Urban Growth <br />Boundary has provided numerous opportunities for citizen involvement. A public involvement <br />plan for the Goal 5 process was reviewed and approved by the Joint Planning Commission <br />Committee in May, 2000. In June 2000, two public workshops were held to provide an overview <br />of the Goal 5 process for Springfield, Eugene and Lane County within the Metro Plan boundary. <br />In April 2001, a public workshop has held to review the draft inventory and significance criteria <br />for Springfield, Eugene and Lane County within the Metro Plan boundary. On December 17, <br />2002, a public hearing was held before the Eugene Planning Commission on the Goal 5 <br />inventory of riparian and upland wildlife habitat sites within the urban growth boundary. All <br />owners of affected and adjacent properties were notified, in addition to a large list of interested <br />parties. The Eugene Planning Commission opened the public record for additional written <br />comments from February 3, 2003 to February 7, 2003 and from March 17,2003 to March 28, <br />2003. The Eugene Planning and Development Department staff held a public information <br />meeting on May 21, 2003 on the status ofthe Goal 5 inventory. On June 9, 2003 a public <br />hearing was held before the Eugene City Council. In addition to public meetings and mailed <br />notices, printed materials related to these proceedings were made available at Planning and <br />Development Department offices and via the City's Internet site prior to each meeting. The <br />inventory that was adopted through the process described above was the groundwork for the <br />updated inventory that is a part of the ordinance now being considered. <br /> <br />1 <br />
