Over the past
3 years my property has been "in" then "out" then "in". The latest written notice from the city said I was
"in" because I was "adjacent" to a protected parcel/stream (E38A) Map 12. (The location of the
seasonal stream on the map is also incorrect by about 80 feet) However, when I called Neil Bjorkland,
he said my written notice was in error. I thought that ended it.

After listening to the testimony last night, I am now not sure. I plan to submit something to try to
protect my right to sue the City, but it would seem that taking the time to identify the effects on each
property would be a better way to go.

Sincerely,

Ward and Leslie Beck
2502 Highland Drive
Eugene, OR 97403

9/27/2005
