<br /> <br />ECC <br />UGENE ITY OUNCIL <br />AIS <br />GENDA TEM UMMARY <br /> <br /> <br /> <br /> <br />Sale of Property to Oregon Department of Transportation <br /> <br /> <br />Meeting Date: December 8, 2008 Agenda Item Number: 3E <br />Department: Public Works Staff Contact: Mark Schoening <br />www.eugene-or.gov Contact Telephone Number: 682-5243 <br /> <br /> <br /> <br /> <br />ISSUE STATEMENT <br /> <br />The City Council is requested to approve the sale of approximately 193 square feet of City-owned <br />property plus an additional 33 square feet of slope easement to the Oregon Department of Transportation <br />(ODOT). ODOT needs the subject areas for its proposed public improvement project at the northeast <br />corner of the Beltline and Coburg Road intersection. <br /> <br /> <br />BACKGROUND <br />The City purchased the parent parcel for a drainage way corridor in 1971. The subject area of the <br />proposed sale does not include or affect the actual drainage way or the City’s continued use for drainage <br />purposes. Public Works staff is supportive of the sale. No negative impacts are noted to utilities, police, <br />or fire. <br /> <br /> <br />RELATED CITY POLICIES <br />Sustainable Development <br /> <br />· <br /> A community that meets its present environmental, economic, and social needs without <br /> compromising the ability of future generations to meet their own needs. <br /> <br />Effective, Accountable Municipal Government <br /> <br />· <br /> A government that works openly, collaboratively, and fairly with the community to achieve <br /> measurable and positive outcomes. <br /> <br /> <br />COUNCIL OPTIONS <br /> <br />The council has the option of either accepting or rejecting the proposed sale to ODOT. If the council <br />concurs with the proposed sale and terms, it may consummate the transaction consistent with Eugene <br />Code 2.868 which states “the council may dispose of real property to any governmental entity without <br />notice or hearing.” <br /> <br />If the council chooses to reject the proposed sale, it may elect to renegotiate modifications to the <br />proposed sale terms or be subject to an eminent domain action if the state determines the need to do so. <br /> <br /> <br /> Z:\CMO\2008 Council Agendas\M081208\S0812083E.doc <br /> <br />
