Occasionally, night work is necessary due to traffic <br />or other considerations, and flexibility in these unique situations would be good. <br /> <br />Finding: There are situations where night operations are necessary or required by the City. An <br />exemption to the regular work hours may be granted by the City under an issued permit or in <br />response to an emergency. Requests for an exemption should be made with as much advance <br />notice as possible. Requests may be submitted as part of a permit application or to the Utility <br />Inspector for consideration. <br /> <br /> <br />Question 24: Section 3.08 Erosion Prevention, Site Restoration and Cleanup, erosion BMP’s <br />require gravel construction site entrances. Is this requirement applicable to work within an <br />existing paved right-of-way? <br /> <br />Finding: Gravel construction site entrances are appropriate to prevent tracking of soil and <br />debris from a construction site onto the road where it could enter the storm system. Excavation <br />within a paved street is different; however, appropriate controls must be in place to avoid <br />tracking or dirt from the excavation from entering the storm system. While the setting is different, <br />the BMP for maintaining clean stormwater discharge is the same. <br /> <br /> <br />Question 25: Section 3.13.1 Damage to City-owned Facilities, identifies the permittee as <br />responsible for repairs for any damaged City owned facilities. Can this requirement only apply to <br />facilities which are properly located to the standards set through Oregon Utility Notification <br />Center and Oregon Administrative Rules? <br /> <br />Finding: A permittee is required to immediately contact the City if there is damage to any <br />facility. Permittees are responsible for repairs and the cost associated with repair. If the <br />permittee believes there is a basis for shared or other party responsibility, a claim should be <br />filed with the City of Eugene Risk Services. When the permittee contacts the City regarding a <br />damage, the City may choose to affect the repair and absorb the cost or bill the responsible <br />party.
