7 <br />lll. Tenant is any Person that has an agreement with the City for occupying space at the <br />Airport. <br /> <br />mmm. Terminal is the commercial passenger terminal located at the Airport. <br /> <br />nnn. Through-the-Fence Operations means the movement of Aircraft between the AOA at the <br />Airport and land adjacent to, but not part of, the Airport property or the unauthorized <br />providing of services at the Airport by a Person that has not entered into an Agreement <br />with the City. <br /> <br />ooo. Transportation Network Company (TNC) means any company that provides app-based <br />transportation services for hire to persons using the Airport. <br /> <br />ppp. TSA is the Transportation Security Administration. <br /> <br /> <br />SECTION B. -- LEGAL AUTHORITY, EFFECTIVENESS, AND IMPLEMENTATION <br /> <br />I. Legal Authority and Purposes <br /> <br />a. The Airport is owned and operated by the City, which has the sole authority to: (a) approve <br />or deny the occupancy, use, or development of land or improvements at the Airport, (b) <br />grant the right to engage in any business at the Airport, including Aeronautical Activity or <br />Commercial Aeronautical Activity, and (c) approve, adopt, amend, or supplement any <br />Agreement, policy, or practice relating thereto, including the Airport’s Rules and Standards. <br /> <br />b. As set forth by the FAA, by way of the Airport Grant Assurances, any Airport developed <br />with federal grant assistance is required to operate for the use and benefit of the public and <br />shall be made available to all types, kinds, and classes of Aeronautical Activity on fair and <br />reasonable terms and without unjust discrimination. <br /> <br />c. The Rules and Standards are subject and subordinate to the provisions of any Agreements <br />between the Airport and the State of Oregon or the United States pertaining to the planning, <br />development, operation, and management of the Airport and are specifically subordinate <br />to, and shall be construed in accordance with, the Airport Grant Assurances. <br /> <br />d. In accordance with the Airport Grant Assurances given to the federal, state, or local <br />government to the Airport as a condition to receiving federal or state funds, the granting of <br />rights or privileges to engage in Aeronautical Activities shall not be construed in any <br />manner as affording any Person any exclusive right, other than the exclusive use of a <br />Person’s Lease Premises and then only to the extent provided in such Agreement. <br /> <br />e. The purpose of these Rules and Standards is to foster an environment at the Airport that <br />ensures: (a) Aviation safety and security, (b) the consistent provision of quality Aviation <br />products, services, and facilities, (c) the development of quality aviation improvements, (d) <br />the orderly development of airport property for aviation purposes, (e) similarly situated <br />Persons are treated equitably and consistently in accordance with the Airport Grant <br />Assurances, and (f) persons or entities proposing to use or access Airport property or <br />facilities for Aeronautical Activity compensate the City for the use of Airport property at fair <br />market rent for such use and privilege. <br /> <br />f. All qualified and experienced Persons desiring to engage in Aeronautical Activities at the <br />Airport will have a reasonable opportunity, without unjust discrimination, to engage in such <br />Aeronautical Activities, subject to fully complying with these Rules and Standards.
