43 <br />proposed Commercial Aeronautical Activity or Non-Commercial Aeronautical <br />Activity. <br /> <br />5) Insurance. Evidence of insurance, or the specific intent to obtain insurance, <br />consistent with the insurance requirements of the Minimum Standards. <br /> <br />6) Security Deposit. The City reserves the right to request a security deposit with <br />the submittal of the application to indicate the good faith intentions of the applicant <br />and/or to off-set any costs incurred by the City in the consideration of the <br />application. The amount will be determined by the Airport Director based on the <br />nature of the application. <br /> <br />7) Petitions in Bankruptcy. Identify all bankruptcies relating to the applicant and the <br />applicant’s principals for the previous five (5) calendar years from the date of the <br />application. <br /> <br />8) Violations of FAA Regulations. Disclose all documented violations by the <br />applicant and/or the applicant’s principals of FAA regulations for the previous five <br />(5) years from the date of application. <br /> <br />9) Notices of Default. Disclose all default notices and corrective actions relating to <br />the applicant or associated companies for the previous five (5) years from the date <br />of the application. <br /> <br />b. Requirements to provide documentary evidence of financial responsibility, petitions in <br />bankruptcy, information on violations of FAA regulations, and previous notices of default <br />include the requirement to provide such materials and information pertaining to the Person, <br />its principals, and any other Person of whom the principals of the Person are or were <br />principals or managers. <br /> <br />c. If an Entity is formed for the sole purpose of conducting a Commercial Aeronautical Activity <br />at the Airport, the Airport Director may request financial information or financial guarantees <br />of the principals of the Entity. <br /> <br />II. Action on Application <br /> <br />a. Upon receipt of an application, or a statement of interest, and the required security deposit, <br />or on its own initiative, the City may issue a request for qualifications or proposals or <br />otherwise select a Commercial Aeronautical Operator through a competitive solicitation in <br />which case the applicant is qualified to response with a proposal to the public solicitation. <br /> <br />b. The Airport Director may deny an application upon finding any of the following: <br /> <br />1) The Commercial Aeronautical Activity or Non-Commercial Aeronautical Activity <br />proposed by the applicant would not meet the Minimum Standards prescribed <br />herein. <br /> <br />2) The City has determined, upon examination of the applicant’s business plan, <br />financial plan, and information submitted to establish financial responsibility, that <br />the applicant is unlikely to be able to continue to meet the Minimum Standards <br />prescribed herein throughout the term of an Agreement, including the payment of <br />the required rates, fees, and charges. <br /> <br />3) The applicant has supplied the City, or any other Person, with false or misleading <br />information or has failed to make full disclosure in their application or supporting <br />documents.
