<br />to provide: <br /> <br />9.5250 <br /> <br />@ <br /> <br />09/17/05 <br /> <br />@ <br /> <br />within the /WB overlay zone shall be exempt from the site <br />review requirements of this subsection (2)(b) if the proposed <br />activity is authorized: <br />a. Under a Mitigation Improvement Plan approved by the <br />Oregon Department of State Lands, and if requiredJ the <br />U. S. Army Corps of Engineers; <br />b. Under a wetland restoration permit or wetland <br />enhancement permit approved by the Oregon <br />Department of State LandsJ and if required, the U. S. <br />Army Corps of Engineers; or <br />c. By a oFinding of No Significant Impacf' or a "Record of <br />Decision" under the federal National Environmental <br />Policy Act (NEPA). <br /> <br />Section 22. Subsection (1 )(b) of Section 9.5250 of the Eugene Code. 1971. is amended <br /> <br />Farm Animal Standards. All of the following standards are applicable to farm <br />animals: <br />(1) Farm Animals Allowed: <br />(a) Except as provided in subsection (1}(b) below, up to 2 adult rabbits or <br />fowl (no roosters) over 6 months of age are aflowed in any residential <br />zone. <br />(b) Rabbits, fowl (no roosters), cows, horses, sheep, goats. emus, and <br />llamas are allowed in AG and R.1. There is no limit on the number of <br />fowl (no roosters) or rabbits over 6 months of age permitted in AG and <br />R-1 provided they are on [1ets-efJ a development site that contains at <br />least 20.000 square feet and they meet the farm animal standards. <br /> <br />Section 23. The lead paragraph of Section 9.5350 of the Eugene Code, 1971, is <br />amended, and a new Subsection (13) is added thereto. to provide: <br /> <br />9.5350 <br /> <br />@ <br />@ <br /> <br />Home Occupation Standards. Except for garage sales lasting no more than 3 <br />consecutive days no more than 3 times in a year, and day care facilities. which are <br />exempt, home occupations [in aU residential zones] shalt be subject to the following <br />standards: <br /> <br />(13) A home occupation shall not be permitted in a dwelling located on a flag <br />lot. <br /> <br />Section 24.
