<br />09/27/05 <br /> <br />Section 74. The attached Figure 9.0500 Lot Lines, Lot Frontage, Lot Width, Lot Depth, <br /> <br />and Industrial Corridor Map 9.7805 are hereby adopted as amendments of, and replacements <br />for. the existing Figure 9.0500 and Map 9.7805. <br /> <br />Section 75. The legislative Findings attached as Exhibit A hereto are adopted in support <br /> <br />of this Ordinance. <br /> <br />Section 76. The City Recorder, at the request of, or with the concurrence of the City <br /> <br />Attorney, is authorized to administratively correct any reference errors contained herein, or in <br /> <br />other provisions of the Eugene Code, 1971 to the provisions added, amended, or repealed <br /> <br />herein. <br /> <br />Section 77. If any section, subsection, sentence, clause, phrase or portion of this <br /> <br />Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, <br /> <br />such portion shall be deemed a separate, distinct and independent provision and such holding <br /> <br />shall not affect the validity of the remaining portions hereof. <br /> <br />Section 78. Sections 37 and 39 of the Eugene Charter of 2002 require that procedures <br /> <br />for vacating a public improvement be regulated by general ordinance, that any ordinance <br /> <br />amending those procedures not take effect for a period of six months after the date of adoption, <br /> <br />and then only if the ordinance is approved by an affirmative vote of six councilors. Pursuant to <br /> <br />those Charter provisions, the amendments to Sections 9.7055, 9.7405, 9.8700, 9.8710. 9.8715, <br /> <br />and 9.8720 of the Eugene Code, 1971 as set forth herein shall become effective six months <br />after the date this Ordinance is adopted, and then only if this Ordinance is approved by an <br /> <br />affirmative vote of six councilors. <br /> <br />Section 79. Notwithstanding the effective date of ordinances as provided in the Eugene <br />Charter of 2002, this Ordinance shall become effective 30 days from the date of its passage by <br /> <br />the City Council and approval by the Mayor, or upon the date of its acknowledgment as <br />provided by ORS 197.625, whichever date is later.
