Debarment of Prospective Offerors <br />1) Generally. A Contracting Agency may Debar prospective Offerors for the reasons set for <br />the in ORS 279A.110 or after providing notice and the opportunity for hearing as set forth in <br />ORS 279B.130. <br />2) Responsibility. Notwithstanding the limitation on the term for Debarment in ORS <br />279B.130(1)(b), a Contracting Agency may determine that a previously Debarred Offeror is <br />not Responsible prior to Contract Award. <br />3) Imputed Knowledge. A Contracting Agency may attribute improper conduct of a Person or <br />its affiliate or affiliates having a contract with a prospective Offeror to the prospective <br />Offeror for purposes of Debarment where the impropriety occurred in connection with the <br />Person’s duty for or on behalf of, or with the knowledge, approval, or acquiescence of, the <br />prospective Offeror. <br />4) Limited Participation. A Contracting Agency may allow a Debarred Person to participate in <br />solicitations and Contracts on a limited basis during the Debarment period upon Written <br />determination that participation is Advantageous to a Contracting Agency. The <br />determination shall specify the factors on which it is based and define the extent of the <br />limits imposed. <br />Related State Statutes: ORS 279.065 & 279B.130 <br /> <br /> <br />137-047-0600. Offer Evaluation and Award <br />1) Contracting Agency Evaluation. The Contracting Agency shall evaluate Offers only as set <br />forth in the Solicitation Document, pursuant to ORS 279B.055(6)(a) and 279B.060(6)(b), <br />and in accordance with applicable law. The Contracting Agency shall not evaluate Offers <br />using any other requirement or criterion. <br />a) Evaluation of Bids. <br />A) Nonresident Bidders. In determining the lowest Responsive Bid, the Contracting <br />Agency shall apply the reciprocal preference set forth in ORS 279A.120(2)(b) and <br />OAR 137-046-0310 for Nonresident Bidders. <br />B) Public Printing. The Contracting Agency shall for the purpose of evaluating Bids <br />apply the public printing preference set forth in ORS 282.210. <br />C) Award When Bids are Identical. If the Contracting Agency determines that one or <br />more Bids are identical under OAR 137-046-0300, the Contracting Agency shall <br />Award a Contract in accordance with the procedures set forth in OAR 137-046- <br />0300. <br />b) Evaluation of Proposals. <br />A) Award When Proposals are Identical.
